¶1Affidavit of compliance filed today is taken on record.

¶2Heard Sri Tej Bahadur Rai, learned counsel for the petitioner, Sri Ankur Agarwal, learned counsel for the respondent no.5 and learned Additional Chief Standing Counsel for the State.

¶3From the compliance affidavit it transpires that the disciplinary authority, namely, the Board of Revenue was not satisfied with the enquiry report in which the petitioner has stood exonerated and accordingly issued him a show cause notice on 14.11.2023 asking the explanation with regard to certain findings arrived at in the enquiry report.

¶4Petitioner claims that this could have been done earlier even but it is after the writ petition was entertained that the respondents have just geared up to finalize the proceedings by issuing show cause notice. This is certainly going to affect the chance of petitioner for promotion in near future.

¶5Be that as it may, since the petitioner has been served with the show cause notice, it is hereby provided that he shall be submitting reply within 14 days from today and if he does so, entire proceedings shall be brought to its logical end in the next 30 days' time.

¶6In the meantime if the Departmental Promotion Committee continues, it will keep the petitioners' promotion in the sealed cover by adopting the procedure prescribed for.
