Judgment
Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 8356 of 2023 Applicant :- Vasudev Goswami And 31 Others Opposite Party :- Sr. Sudhakar Pandey, Chief Medical Officer And 2 Others Counsel for Applicant :- Kamlesh Kumar Tiwari Hon'ble Rohit Ranjan Agarwal,J. The writ Court on 04.07.2023 while disposing of Writ-A No.9456 of 2023 had passed the following order:- "The grievance of the petitioners in the present petition is that they are not being paid their annual increment payable to them. The petitioners have been appointed on contractual basis under the National Health Mission Programme. In this regard, the petitioners have already made a representation before the Chief Medical Officer, Jhansi. The petitioners may make a fresh representation before the Chief Medical Officer, Jhansi bringing all the necessary facts to his notice who on receipt of the said representation shall decide the same and take appropriate action in accordance with law within a period of three months from the date the representation is filed before him. With the aforesaid directions, the petition is disposed of." From the perusal of the aforesaid order, it is clear that a direction was given to the opposite party to decide the representation of the applicants. Pursuant to the order passed by the writ Court, the opposite party on 31.10.2023 had decided the representation of the applicants rejecting their claim. In view of the said fact as the order of the writ Court has been complied with and the representation of the applicants has been decided, present contempt application is rendered infructuous and the same stands dismissed. However, it is open to the applicants to assail the order passed by the opposite party before appropriate forum, if so advised.
