¶1Heard learned counsel for the parties.

¶2Petitioner who belongs to Medical and Health Department, came to be posted in the Department of Medical Education at Government Medical College, Azamgarh. This charge was by way of deputation till the joining of regular candidate on recommendation of the Uttar Pradesh Public Service Commission.

¶3Learned Standing Counsel has obtained instruction and as per instruction the regularly selected candidate has been given posting and joining and resultantly petitioner has stood relieved.

¶4The grievance remains as to the petitioner is that since the respondents could not have relieved petitioner, his future hangs imbalance and the Medical Education Department is not giving her joining.

Lucknow about the relieving of the petitioner on account of selected candidate coming and joining the institution.

¶6In the given facts and circumstances, therefore, since the petitioner also does not dispute that his parent department is Medical Education, Uttar Pradesh, it is hereby provided that the petitioner shall be approaching the Director General, Medical Education, Uttar Pradesh within two weeks from today by making application for giving her proper posting as a result of a candidate joining in her place in the Government Medical College upon her promotion by selection by the Public Service Commission and the respondents shall be doing the needful within next two weeks thereafter. The regular period during which petitioner remains relieved and is not posted anywhere shall be counted towards this service period and she shall also be entitled to salary and no coercive measure shall be taken against her.
