¶1Heard Mohd. Achhay, learned counsel for the petitioners and Shri Virendra Kumar Pal, learned AGA appearing for the State respondents.

¶2By means of the present petition the petitioners are seeking a direction in the nature of mandamus commanding/directing the respondent nos.2 and 3 to ensure fair investigation in pursuance of the FIR dated 10.09.2023, registered as case crime no.410 of 2023, under section 452, 323, 504, 354B and 506 IPC, P.S. Nawabganj, District Prayagraj.

¶3A preliminary objection has been raised that the petitioners, who are accused are claiming fair investigation and as such the present writ petition is not maintainable.

¶4At this stage, learned counsel for the petitioners submitted that he may be permitted to withdraw the present petition.

¶5The writ petition is accordingly dismissed as withdrawn.
