¶1The instant intra-court appeal is directed against an interim order dated 03.10.2023 passed by learned Single Judge in Writ-A No. 10513 of 2023 (Yogendra Kumar vs. State of U.P. and 4 others). The order was operative up till the next date of listing i.e. 19 October 2023.

¶2Counsel for the respondent admits that the interim order was not extended.

¶3Since interim order has not been extended as admitted by counsel for the respondent, therefore, we permit the appellants to withdraw the appeal with liberty to file fresh appeal in case the interim order is extended. We also grant leave to the appellants to move proper application before learned Single Judge along with their version in the meantime so that the same is considered if any request is made for extension of the interim order.
