In pursuance of the earlier order, instructions have been obtained on behalf of respondent no.1, which are taken on record. On the strength of said instructions, learned counsel appearing for the Union of India submits that it is correct that the post of Presiding Officer in CGIT Kanpur is lying vacant and the Presiding Officer, CGIT, Lucknow has been given additional charge of CGIT Kanpur. In view of the above, he submits that the matter may be relegated to the appropriate authority. To the said submission, learned counsel appearing for the petitioner submits that since the authority concerned was vacant, therefore, he could not approach the same and now the time has lapsed to approach the authority concerned. In view of the above, matter is disposed of directing the petitioner to approach the authority concerned within 15 days from today and if such application is filed, the same shall be considered without raising any objection with regard to the limitation.
