Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 14714 of 2023 Petitioner :- Wazid Ali And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Anand Prakash Dubey,Krishna Kant Dubey Counsel for Respondent :- G.A. Hon'ble Anjani Kumar Mishra,J. Hon'ble Arun Kumar Singh Deshwal,J. Heard learned counsel for the petitioners and learned A.G.A. for the State. The instant writ petition seeks quashing of the FIR dated 6.5.2022 giving rise to Case Crime No. 170 of 2022, under Sections 420, 323, 504, 467, 468, 471, 120B I.P.C., Police Station-Civil Lines , District-Meerut. Contention of learned A.G.A. is that from the allegations in the F.I.R., it emerges that the petitioners had purchased at best about 4,000 Sq. meters of land from the informant. The sale deeds that are available in the case diary, reveal that almost 6,000 sq. meters of land has been sold by the petitioners and, therefore, the allegation in the F.I.R. is totally and completely borne out. It has also been submitted that the petitioners were recorded over the 4,000 sq. meters of land, purchased by them in the year 2020 on the basis of the sale deed executed in the year 2015. They have, therefore, clearly executed the sale deeds of the land prior to the name being recorded in the Khatauni and therefore also the allegation in the F.I.R. contains the ingredients of cognizable offence. Under the circumstances, no case for interference is made out. The writ petition is, therefore, dismissed. Order Date :- 20.11.2023 Vandana High Court of Judicature at Allahabad
