¶1Heard learned counsel for the applicant and learned AGA for the State.

¶2The present application u/s 482 Cr.P.C. has been filed by the applicant with the prayer to modify the order dated 14.09.2023 in Criminal Appeal No.46 of 2023, under Section 138 of N.I. Act, Police Station Nababad, District Jhansi.

¶3Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present matter. Further submission is that no prima facie case is made out against the applicant.

¶4On the other hand, learned AGA has opposed the prayer but could not dispute the aforesaid fact.

¶5Keeping in view the aforesaid submissions and contention made by the learned counsel for the parties, the application is disposed off with a direction to the applicant to move an application before the court concerned for relaxation of the condition imposed upon the applicant, which shall be heard and decided in accordance with law.
