Hon'ble Manoj Bajaj,J. Petitioners have filed this petition under Section 482 Code of Criminal Procedure to challenge the complaint bearing Case No. 213 of 2022, titled Smt. Omwati Vs. Surendra and others, under Sections 498-A, 323, 504, 506 I.P.C., Police Station Mahila, District Rampur as well as the summoning order dated 26.9.2023 passed by Civil Judge (J.D.)/ Fast Track Court, Rampur. Learned counsel for applicants submits that complainant has falsely implicated all the close relatives of her husband (applicant no.1) and the husband (applicant no.1) is willing to settle the dispute with the complainant. When confronted with the maintainability of the application, in view of the availability of alternative remedy of revision against the impugned order issuing process against the applicants, learned counsel for applicants prays for withdrawal of this application with liberty to approach the court of sessions.
