¶1Heard Sri Prem Shankar, learned counsel for the petitioner as well as learned AGA for the State the perused the record.

¶2This petition has been filed on behalf of the Manager/ Secretary, Kamlesh Yadav, son of R.N. Yadav, Private Industrial Training Institute, Rudrapur, Tappa Patara, Pargana Haveli, Chauri Chaura, District Gorakhpur.

¶3Submission advanced by learned counsel for the petitioner is that Kamlesh Yadav is a person who has the criminal history of 35 cases and, therefore, the District Magistrate has attached all the properties raised by him. The underline idea of this provision is to attach such properties, whereby the District Magistrate of the district has every reason to believe that such movable or immovable property is a result of ill-gotten money of that gangster.

¶4The petitioner is directed to move a fresh representation before relevant District Executive / Police authorities of the District Gorakhpur, as contemplated under Section 15 of the Uttar Pradesh Gangster & Anti Social Activities (Prevention), Act, 1986. If such a representation is moved by the petitioner by 30.11.2023, the same shall be disposed off/ decided by concerned District Executive / Police Authorities strictly, adhering to the basic norms of natural justice by speaking order within thirty days from the institution of the representation.
