Judgment
Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 5540 of 2021 Applicant :- Ravindra Kumar Opposite Party :- Dr Anju Singh, Regional Officer And Another Counsel for Applicant :- Kalp Nath Rai Counsel for Opposite Party :- Nipun Singh,Mata Prasad Hon'ble Rohit Ranjan Agarwal,J. The writ Court on 17.02.2021 while disposing of Writ-A No.236 of 2021 had passed the following order:- "Heard learned counsel for parties. Learned Standing Counsel representing the third respondent states that subject to all contentions of respective parties being kept open and the petitioner filing a detailed representation in respect of his claim which is raised in this petition within a period of two weeks from today, the same shall be duly evaluated and a final decision communicated in respect thereof with expedition and preferably within a period of four months therefrom. The respondent no.3 shall proceed in the matter with due notice to the respondent nos.4 and 5. Accordingly, this petition shall stand disposed of in light of the statement noted above. All contentions of respective parties on merits are kept open." From the perusal of the aforesaid order, it is clear that the Court had disposed of the writ petition directing the third respondent i.e. State to decided the representation of the applicant. An affidavit of compliance has been filed on behalf of the Principal of the Institution, wherein in para 10, it has been stated that the Regional Higher Education, Meerut had decided the representation of the applicant on 06.01.2022, copy of which has been appended as Annexure-1 to the said affidavit. As the order of the writ Court was only to the extent to decide the representation of the applicant, which the authorities had done, the present contempt application is rendered infructuous and the same stands dismissed. However, it is open to the applicant to assail the order passed by the opposite party before appropriate forum, if so advised.
