Sri Kunal Ravi Singh, learned counsel for the respondent no. 2 submits that present petition is not maintainable as no appeal, as provided under the Act, has been preferred, whereas the petitioner has annexed as annexure no. 4 an application treating it to be an appeal. Confronted with the said fact, learned counsel for the petitioner comes up with a prayer to withdraw this writ petition with liberty to file a fresh petition with better particulars and details.
