Court No. - 68 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 48238 of 2023 Applicant :- Kaushal Anand Opposite Party :- State of U.P. Counsel for Applicant :- Vikas Srivastava Counsel for Opposite Party :- G.A.,Jitendra Pal Singh Jadaun,Seema Singh Jadaun Hon'ble Dr. Gautam Chowdhary,J.
¶1Vakalatnama of Shri J. P. S. Jadaun, Advocate on behalf of informant and two supplementary affidavits filed on behalf of applicant are taken on record.
¶1Heard learned counsel for the applicant, learned A.G.A for the State as well as learned counsel for the informant and perused the record.
¶2Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that victim herself lodged the present F.I.R. against the applicant with the allegation that initially applicant made friendship relations with her through facebook and whatsapp, thereafter, he developed relations with her, thereafter, on 19/20.04.2022 he took her in a restaurant in his car and served her intoxicated drink on account of which she became unconscious and applicant committed her rape forcibly in his car, thereafter, he left her to her house, thereafter, she used to give her gifts, he also took her some photographs and threatened her to viral the same on social media, thereafter, she went Mumbai, where the applicant also reached there and made physical relations with her forcibly. Learned counsel for the applicant further submits that as per prosecution version initially the alleged incident took place on 20.04.2022 and the F.I.R. has been lodged on 23.06.2022 with a great delay without any plausible explanation made therein. Learned counsel for the applicant further submits that the victim in her statements recorded under Section 161 & 164 Cr.P.C. has repeated the same version of the F.I.R. and made allegation of rape against the applicant. Learned counsel for the applicant further submits that victim was also physically examined where four simple injuries were found present on her person. Learned counsel for the applicant further submits that victim has refused for her medical examination to be conducted. Learned counsel for the applicant further submits that as victim has herself refused for her medical examination, therefore, in absence of any medical opinion the allegation of rape made by the victim cannot be proved. Learned counsel for the applicant further submits that as per the version of the F.I.R. and as per statements of the victim recorded under Sections 161 & 164 Cr.P.C. there is allegation of rape committed by the applicant upon the victim, but prior to the incident the victim and the applicant used to talk each other and they knew each other very well, thus, it appears that victim is a consenting party, thus, applicant has falsely been implicated in the case. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. Learned counsel for the applicant further submits there is a criminal history of applicant of three cases, which has been explained by him in para-31 of the affidavit filed in support of the bail application. He next submits that applicant is languishing in jail since 26.09.2023.
¶3Per contra, learned A.G.A. as well as learned counsel for the informant have opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre trial stage, therefore, he does not deserve any indulgence.
¶4After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, the nature of evidence and also the absence of any convincing material to indicate the possibility of tampering with the evidence, without expressing any opinion on merits of the case, this Court is of the view, that the applicant may be enlarged on bail.
