This petition has been seeking a direction to the trial court to decide the Original Suit No.138 of 2016 (Vijay Kumar & Anr. vs. Rajaram & Ors.), that is pending in the court of Civil Judge (Junior Division) FTC-II, Varanasi, within a specific period. It appears that the aforesaid suit was filed on 30.1.2016 seeking a relief of permanent injunction with regard to the suit property which appears to be an agricultural property. It appears from the certified copy of the order-sheet that has been filed with the petition, that the issues are yet to be framed. If that be so, it is expected that the trial court would proceed to frame the issues if the defendants are duly served and written statements have been filed. Since the matter is of the year 2016, therefore, it is required to be proceeded without granting any unnecessary adjournments to either of the parties, provided there is no legal impediment.
