Judgment
Court No. - 44 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 49332 of 2023 Applicant :- Mohd. Arman @ Abu Talha Opposite Party :- State of U.P. and Another Counsel for Applicant :- Shamasul Eslam Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J.
¶1Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.
¶2It is argued by the Counsel for the applicant that two co-accused Said Ali and Izharul Haque have been enlarged on bail by this Court vide order dated
10.10.2023 and 06.11.2023 respectively. The allegations against the applicant are similar to to-accused Said Ali and the applicant has no criminal antecedents. He further argues that the applicant is entitled to be released on bail on the ground of parity.
¶3Learned A.G.A. vehemently opposed the bail prayer.
¶4Considering the fact that on similar allegations, the co-accused Said Ali has been enlarged on bail, I am of the view that the applicant is entitled to be released on bail on he ground of parity. Accordingly, the bail application is allowed.
¶5Let the applicant Mohd. Arman @ Abu Talha be released on bail in FIR/ Case Crime No.134 of 2023, under Sections 34, 419, 420, 467, 468, 471, 370, 120B IPC, Section 12(1), 12(2) Passport Act and Section 14 of Foreign Act, Police Station Kotwali, District Ballia on his furnishing personal bonds and two reliable sureties of Rs.25,000/- each to the satisfaction of the court concerned with the following conditions:
