Hon'ble Syed Aftab Husain Rizvi,J. Petitioners are claiming right over plot no.976/1 area 0.1450 hectare at village Naglatashi Kasampur, Pargana-Meerut, Tehsil Meerut Sadar, District Meerut. It is asserted that certain dispute in respect of the property is pending and in view of the orders passed by the competent court the petitioners are entitled to continue. Grievance is that without acquiring petitioners' plot the part of their land has been included in the plots carved out by the Meerut Development Authority, which has transferred it to a builder. Submission is that grievance is that regard has been raised by the petitioners before the Development Authority, which has not been adjudicated and the authorities are trying to dispossess them. Learned counsel appearing for the respondent Development Authority states that the dispute raised by the petitioners is non-existent and at best requires demarcation of petitioners' land vis-a-vis other persons for which remedy lies elsewhere. Be that as it may, in the facts of the case, we permit the petitioners to represent their grievance before respondent no.2, within two weeks from today alonwith certified copy of this order, annexing all materials in support of their claim. An appropriate decision would be taken in the matter by the respondent no.2, by passing a reasoned speaking order, in accordance with law, within a further period of two months, thereafter. In the event there is a boundary dispute or issue of demarcation etc. it shall be open for the persons aggrieved to approach the competent forum.
