¶1The impugned order purports to reject the prayer for mutation of the name of the petitioners in the records of Cantonment Board on the ground that in respect of part of subject land, which is old grant, there is no provision of mutation of name and in respect of remaining area i.e. 290 square feet, which is leased land, the lease has expired.

¶2Learned counsel for the petitioners submits that the prayer of the petitioner for renewal of lease has not been considered by the Cantonment Board so far. He submits that the petitioner be permitted to approach the authority with prayer for renewal of the lease.

¶3Sri Akash Sharma, holding brief of Sri Sanjay Kumar Om, learned counsel for the Cantonment Board has no objection to the same.

¶4Accordingly, the petition is disposed of as withdrawn with liberty to the petitioners to press their prayer before the competent authority for renewal of lease and in which event, the prayer shall be considered strictly in accordance with law without being influenced by the fact that the application for mutation of name had been rejected.
