Applicants being accused have approached this Court through this application under Section 482 Code of Criminal Procedure seeking quashing of the summoning order dated 5.1.2023 passed by Judicial Magistrate, Jhansi in Complaint Case No.342 of 2022 (Smt. Snehlata Srivastava Vs. Smt. Manjulata Gupta and others) under Sections 147, 323, 504, 506, 452, 354-B, 387, 427 IPC, Police Station Nawaba, District Jhansi, pending in the court of Judicial Magistrate, Jhansi. Learned counsel for the applicants has stated that after passing of the summoning order dated 5th January, 2023, the parties have amicably settled the dispute on 13.06.2023 (Annexure No.3). He prays that in view of this development, the complaint be quashed by exercising the power under Section 482 Cr.P.C. During the course of hearing, it is not disputed by learned counsel that after summoning of the accused the charges against them have not been framed and since the parties have settled the dispute, it is always open for the complainant to withdraw the complaint, therefore, this Court is not inclined to exercise the inherent power u/s 482 Cr.P.C.
