¶1Heard Shri Ashish Gupta, learned counsel for the petitioner; Shri Sharad Chandra Upadhyay, learned Standing Counsel and Shri Sunil Kumar Singh, learned counsel for Gaon Sabha.

¶2Present writ petition has been preferred for quashing the Tender Notice dated 16.1.2023 issued by respondent no.5 in respect of Gata No.1216 M, situated at Village Sikandrabad Dehat, Tehsil Sikandrabad Dehat, Distt. Bulandshahar and for a further direction to respondent no.5 not to interfere in peaceful possession of the petitioner in respect of Gata No.1216 M, situated at Village Sikandrabad Dehat, Tehsil Sikandrabad Dehat, Distt. Bulandshahar.

¶3In response to the order dated 18.10.2023, learned Standing Counsel has placed the detailed instructions, which is taken on record. As per the instructions, he submits that the lease (patta) accorded in favour of the petitioner is already cancelled by the District Magistrate, Bulandshahar and similar matter is already engaging the attention of learned Single Judge.

¶4Confronted with this, learned counsel for the petitioner states that he is not inclined to press the writ petition. However, it is prayed that leave may be accorded to challenge the cancellation order before the appropriate Court.
