Court No. - 6 Case :- WRIT - C No. - 38717 of 2023 Petitioner :- Deepak Awana Respondent :- State of U.P. and Another Counsel for Petitioner :- Uma Nath Pandey Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Uma Nath Pandey, learned counsel for the petitioner, learned Standing Counsel for the State-respondent. The writ petition has been filed by the petitioner with a prayer to direct the respondent no.2 to pass an appropriate order on the application of the petitioner dated 04.07.2023, filed under Section 13(2) of the Arms Act, 1959, for extension of area to carry his licensing arms outside the State of U.P., within stipulated period. Learned counsel for the petitioner submits that an application dated 04.07.2023 with regard extension of area to carry his licensing arms outside the State of U.P., has been filed, which is pending. He further submits that petitioner is running a transport business, for which, he travels all over the country, therefore, for safety and security, the extension of area to carry his licensing arms outside the State of U.P., is required. He further submits that a direction may be issued to authorities concerned to take decision on the application of the petitioner, as soon as possible. Learned Standing Counsel has no objection to the aforesaid prayer. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed off with a direction to the respondent no.2, District Magistrate, Gautam Budh Nagar, to decide the application of the petitioner, pending before him, in accordance with law, by means of a reasoned and speaking order, as expeditiously as possible, preferably within a period of six months, from the date of production of certified copy of this order, if there is no legal impediment.
