Heard Mr. Pradeep Kumar Singh, learned counsel for the petitioner and perused the record. This writ petition has been filed by the petitioner with a prayer to direct the concerned court to expeditiously dispose of Motor Accident Claim Petition No.254 of 2004 (Shri Narayan Singh Vs. United Insurance Co. Ltd. through Branch Manager Deoria and another) before Motor Accident Claim Tribunal Deoria (District Judge), within stipulated time period. Learned counsel for the petitioner submits that the claim petition was filed in the year 2004 in which orders were passed in favour of the petitioner against which the respondents have filed restoration, therefore, the matter has been heard again since 2018. Learned Standing Counsel has no objection to the same. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case and without expressing any opinion on the merits of the case, this writ petition is finally disposed off with a direction to the concerned authority/court to decide the claim petition of the petitioner, and pass appropriate order, in accordance with law, by means of a reasoned and speaking order, after giving opportunities of hearing to the parties concerned, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of four months, from the date of production of certified copy of this order, if there is no legal impediment.
