Judgment

Court No. - 6 Case :- WRIT - C No. - 38818 of 2023 Petitioner :- Shashi Bhushan Singh Respondent :- Union Of India And Another Counsel for Petitioner :- Mahendra Kumar Prajapati Counsel for Respondent :- A.S.G.I.,Sujata Choudhary Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Mahendra Kumar Prajapati, learned counsel for the petitioner, Ms. Sujata Choudhary, learned counsel for Union of India and learned Standing Counsel for the State-respondents. This writ petition has been filed by the petitioner with a prayer to direct the Respondent no.2/Railway Claims Tribunal Allahabad Bench, Allahabad to decide the O.A.

(IIu)/ALD/1092/2020 (Shashi Bhushan Singh Versus Union of India through G.M./N.C.R., Subedarganj, Allahabad), within stipulated period. Learned counsel for the petitioner submits that the petitioner met with an accident while travelling from Tapti Ganga Exp. (Train No.9047) Surat to Mirzapur and sustained several injuries. Aggrieved by the same, the petitioner filed a claim before Railway Claim Tribunal in the year 2011 which is still pending, therefore, a direction may be issued to Respondent No.2/ Railway Claims Tribunal Allahabad Bench, Allahabad to decide the same, as expeditiously as possible. Learned Standing Counsel has no objection to the same. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case and without expressing any opinion on the merits of the case, this writ petition is finally disposed off with a direction to the Respondent No.2/Railway Claims Tribunal Allahabad Bench, Allahabad to decide the same, and pass appropriate order, in accordance with law, by means of a reasoned and speaking order, after giving opportunities of hearing to the petitioner, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of four months, from the date of production of certified copy of this order, if there is no legal impediment.
