Judgment
Court No. - 44 Case :- MATTERS UNDER ARTICLE 227 No. - 11764 of 2023 Petitioner :- Rajmangal Tiwari Respondent :- Vishvamitra Tiwari Counsel for Petitioner :- Vinay Kumar Singh Hon'ble Ashutosh Srivastava,J. Heard Shri Vinay Kumar Singh, learned counsel for the petitioner. The present petition, under Article 227 of the Constitution of India, has been filed with the limited prayer to decide the Original Suit No. 1108 of 2008 (Vishvamitra Tiwari Vs. Rajmangal Tiwari), said to be pending since 2008 to be decided, expeditiously. From the order sheet, filed on record, it is borne out that the partition suit is pending at the stage of recording of evidence. Considering the stage of the proceedings this Court is of the opinion that no definite period can be fixed within which the suit can be directed to be decided finally. However, considering the fact that the partition suit is pending since the year 2008, all endeavour shall be made by the Court concerned to decide the suit expeditiously without providing unnecessary adjournments to either of the parties and if, adjournments are sought, appropriate cost may be imposed for allowing the adjournments. With the aforesaid observations the writ petition is disposed of. Order Date :- 22.11.2023 Deepak/ High Court of Judicature at Allahabad
