Judgment
Court No. - 6 Case :- WRIT - C No. - 37577 of 2023 Petitioner :- Ganesh Prasad Respondent :- State of U.P. and Another Counsel for Petitioner :- Rakesh Dubey Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Rakesh Dubey, learned counsel for the petitioner and learned Standing Counsel for the State-respondent. With the consent of learned counsel for the parties, this writ petition is being finally disposed off at this stage without calling for a counter affidavit. The writ petition has been filed by the petitioner with a prayer to direct the respondent no.2 to decide the petitioner's arms license renewal and registration application pending before District Magistrate since 2017. Learned counsel for the petitioner submits that petitioner had retired as Subedar from Indian Army on 01.06.2015. The licensing authority of District Doda, Jammu & Kashmir granted a fire arm license in favour of petitioner bearing License No.222/DM/Doda (J&K) on 14.05.2009 UID No.000610003389 273 2017 of Pistol
0.32 Bore No.RP 150944 and its validity was sanctioned from all over India. The said license was being renewed in continuance by the licensing authority of District Doda, which was extended from
14.05.2017 upto 14.05.2020 and thereafter from 15.05.2020 upto
14.05.2023. The petitioner requested before District Magistrate, Kanpur Nagar to renew his arms license as he is permanent resident of Mohalla Gopal Nagar, P.S. Naubasta, District-Kanpur Nagar. The license granted by licensing authority of District Doda was meant for all across India. The licensing authority of District Kanpur Nagar sent information on several occasions regarding no objection certificate from District Magistrate, Doda, Jammu & Kashmir, which was responded and letters were submitted by the licensing authority District Doda. The petitioner again approached the District Magistrate, Kanpur Nagar, for renewal and registration of petitioner's license but nothing has been done till date, therefore, a direction may be issued to the respondent no.2 to decide the petitioner's arms license renewal and registration application, pending since 2017. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed off with a direction to the respondent no.2, District Magistrate, Kanpur Nagar, to decide the arms license renewal and registration application of the petitioner, in accordance with law, by means of a reasoned and speaking order, as expeditiously as possible, preferably within a period of four months, from the date of production of certified copy of this order, if there is no legal impediment.
