¶1Heard learned counsel for the applicant, learned A.G.A. for the State-opposite party and perused the record.

¶2This application under Section 482 Cr.P.C. has been filed by the applicant with the prayer to quash the NBW order dated

25.08.2023 in Case No. 2747 of 2018 CNR No.UPJP050125282018, (State v. Jai Hind) arising out of Case Crime No. 390 of 2017, under Sections 366, 376 I.P.C., Police Station Kerakat, District Jaunpur, pending in the court of Additional Chief Judicial Magistrate 3rd, Court No.14, Jaunpur and further prayer to stay the further proceedings of the aforesaid case has been made.

¶3After arguing the matter at some length, learned counsel for the applicant prays for withdrawal of this application with liberty to the applicant to file bail application before the court of competent jurisdiction.

¶4Learned A.G.A. has no objection to such request.

¶5In view of the above, the instant application is disposed of as withdrawn with liberty to the applicant to appear before court concerned and file appropriate application for cancellation of NBW/ bail within four weeks, which shall be heard and decided in accordance with law, as expeditiously as possible.
