This petition has been filed with a prayer to direct the learned Additional Chief Judicial Magistrate, District Maharajganj to decide the Complaint Case No.4967 of 2019 (Mohar Prasad Gupta and others Vs. Raj Kumar and others) arising out of Case Crime No.532 of 2007, under Sections 302, 201, 120-B I.P.C., Police Station Nichlaul, District Maharajganj, expeditiously. It has been submitted by learned counsel for the petitioner that the matter pertains to year 2007. After investigation, final report was filed. However, directions were passed for further investigation and again the final report was filed. Subsequently, the protest petition filed by the complainant was treated as a complaint case which is still pending disposal. The statement of the complainant and the witnesses have been recorded under sections 200 and 202 Cr.P.C. respectively. Expeditious disposal of a case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it, expeditiously. Having regard to the facts and circumstances of the case, the court below i.e. Additional Chief Judicial Magistrate, District Maharajganj is directed to make all possible efforts to decide the aforesaid case expeditiously.
