Court No. - 10 Case :- WRIT - C No. - 40166 of 2023 Petitioner :- Km. Shashi Devi And 2 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Babu Lal Ram Counsel for Respondent :- C.S.C Hon'ble Kshitij Shailendra,J.
¶1Sri Adarsh Bhushan, learned counsel for the respondent no.2 has supplied instructions to this Court, which are taken on record.
¶2It is contended by the learned counsel for the petitioners that the petitioners are ready to complete all the formalities concerning the examination including deposit of fees and, therefore, they may be allowed to appear therein and that the examinations shall commence from 25.11.2023.
¶3Sri Adarsh Bhushan, learned counsel for the respondent no.2, on the basis of instructions, submits that the petitioners and the institution failed to deposit the requisite fee within the time scheduled fixed.
¶4It appears that the petitioners as well as the institutions both are at fault, insofar as, the guidelines issued by the respondent no.2 are concerned, however, in the interest of justice, considering the trifling issue of non-deposit of fee only, the writ petition is disposed of in the following terms:
(a) The petitioners are directed to deposit the requisite fee before the respondent no.3 by today or tomorrow along with self attested downloaded copy of this order.
(b) As soon as the said deposit is made, the respondent no.3 shall immediately communicate the said fact to the respondent no.2 through e-mail and all other electronic means as may be available.
(c) The respondent no.2, who is represented by Sri Adarsh Bhushan shall sympathetically consider the cause of the petitioners and in case all the formalities are fulfilled to the satisfaction of the respondent no.2, it shall take immediate decision on or before
24.11.2023 itself regarding appearance of the petitioners in the concerned examinations and shall communicate the decision to the respondent no.3 through e-mail or by any other electronic means.
¶4It is the duty of the petitioners to keep in continuous touch with the respondent no.3 so that the decision taken by the respondent no.2 is communicated to them also. Order Date :- 22.11.2023 CS/- High Court of Judicature at Allahabad
