Judgment
Court No. - 48 Case :- WRIT - B No. - 48562 of 1999 Petitioner :- Sadhu Ram Respondent :- Dy. Director Of Consolidation And Others Counsel for Petitioner :- Pradeep Kumar Rai Counsel for Respondent :- C.S.C.,H.N.Sharma Hon'ble Saurabh Shyam Shamshery,J. Heard Sri Pradeep Kumar Rai, learned counsel for petitioner and Sri A.K. Rai, learned A.C.S.C. for State. The order under challenge is dated 15.9.1998, whereby as many as seven revision petitions were decided by a common order dated
07.09.1999. I have found merit in argument of learned counsel for petitioner that though the submissions were recorded in the impugned order, however, the reasons given therein and corresponding amendment table are not synchronized, therefore, ambiguity has been occurred. Learned A.C.S.C. for State fairly submits that the ambiguity could be cured only if impugned order be set aside and matter is remitted back to concerned authority for fresh consideration after hearing rival parties. Accordingly, impugned order dated 07.09.1999 is set aside and matter is remitted to concerned authority to decide afresh after hearing rival parties, expeditiously. This writ petition is accordingly, disposed of. Order Date :- 22.11.2023 P. Pandey High Court of Judicature at Allahabad
