This writ petition has been filed with the prayer to quash the First Information Report dated 22.10.2023, registered as Case Crime No. 328 of 2023, under Sections 420, 406 and 506 I.P.C., Police Station-Rohaniya, District Varanasi. We have perused the impugned F.I.R. which contains specific allegation with regard to the payment of a sum of Rs.22,00,000/- by cheque and Rs.5 lacs by cash. It is alleged that accused persons with fraudulent intent, on the false premise of transferring land have obtained the amount. Although it is stated that part of the payment has been returned but there is no document in support of such contention. Even otherwise these aspects are to be examined at the stage of investigation. Since prima facie allegations with regard to commissioning of offence are made out, we decline the prayer made to quash the F.I.R. Writ petition is dismissed, accordingly.
