¶1Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.

¶2It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the F.I.R. was lodged against the applicant alleging therein that on the last night when his minor daughter aged about 16 years went outside the house to meet nature call then the applicant caught her and committed her rape forcibly, when accused was committing rape of her minor daughter, she made noise then the complainant and his son went outside the house and tried to catch the applicant but he fled away while abusing him by caste. Learned counsel for the applicant further submits that complainant has repeated the same version of F.I.R. in his statement recorded before the police. Learned counsel for the applicant further submits that in her statement recorded under Section 161 Cr.P.C. the victim has stated that on the date of incident at about 1:00 a.m. in night she was sleeping on the roof of the house, at that time when she had gone to bathroom then applicant was present on the staircase, he took her and after closing the door he committed her rape and when she made noise her family members reached there, whereas in her statement recorded under Section 164 Cr.P.C. the victim has stated that applicant committed her rape forcibly and she was alone in the house. Learned counsel for the applicant further submits that in her medical examination her hymen was found old, torn and healed, and no any sign of sexual assault found on the internal or external examination of the victim, however, final opinion was reserved pending as availability of FSL report and sexual violence cannot be ruled out. Learned counsel for the applicant further submits that till date no FSL report is available, which fact has also been confirmed by the learned A.G.A. Learned counsel for the applicant further submits in the supplementary medical examination report of the victim she was found to be aged about 18 years. Learned counsel for the applicant further submits that there are several contradictions in the statements of the victim recorded under Section 161 & 164 Cr.P.C. and the medical report of the victim also does not support the prosecution case. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. He next submits that applicant is languishing in jail since 03.09.2023, having no criminal history.

¶3Per contra, learned A.G.A. has opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre trial stage, therefore, he does not deserve any indulgence.

¶4After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, the nature of evidence and also the absence of any convincing material to indicate the possibility of tampering with the evidence, without expressing any opinion on merits of the case, this Court is of the view, that the applicant may be enlarged on bail.
