Applicant has filed this application under Section 482 Code of Criminal Procedure to challenge the Case No. 2313 of 2011 (State vs. Triveni), arising out of Case Crime No. 191 of 2011, under sections 323, 504, 506 and 354 I.P.C., P.S. Nebua Naurangiya, district-Kushinagar, as well as order dated 8.4.2021 passed by Judicial Magistrate, Kushinagar, whereby Non Bailable Warrants have been issued against him to secure his presence. Learned counsel for the applicant prays that he may be permitted to withdraw this application with liberty to file an application to recall of the order dated 8.4.2021 before the Magistrate concerned.
