Sri Sandeep Shukla, learned counsel for the informant informs the Court that the applicant Jony has been convicted by the Special Additional Sessions Judge, POCSO Act, Muzaffarnagar in Sessions Case POCSO No. 1356 of 2021 under Section 343 and 376(3) IPC, P.S.Phugana, District Muzaffar Nagar convicting and sentencing the applicant by judgement and order dated 19.09.2023 and as such the present bail application has rendered infructuous. Accordingly, the present bail application is dismissed as infructuous. Since revelation was made by Sri Sandeep Shukla, learned counsel for the informant, if any change, is there, the applicant may move recall application within a period of three months and the same shall be entertained.
