¶1Case of the petitioners is that National Highway Authority has taken possession of the land of the petitioners in excess to what was acquired under the provisions of the National Highways Act, 1956. In support of their contention, learned counsel for the petitioners has placed reliance on a joint report of the Revenue Team, dated 9.8.2023.

¶2Prayer made in the instant petition is for a direction to the respondents to get the site surveyed and award compensation to the petitioners in respect of the excess land of which possession has been taken by them.

¶3Sri P.N. Rai, learned counsel appearing for respondent nos.1 and 2 submits that District Level Committee would be competent to examine whether any excess land has been taken over and if so, the compensation which has to be paid.

¶4Learned counsel for the petitioners has no objection in case the said Committee is directed to decide the matter.

¶5Accordingly, without expressing any opinion on merits of the case, the writ petition is disposed of with the liberty to the petitioners to make fresh representation along with the attested copy of the instant order before respondent no.3 within two weeks from today and in which event he will place the representation for decision by the District Level Committee within next twelve weeks after giving opportunity of hearing to the petitioners and survey of the site in their presence.
