No one has appeared to press the petition. However, learned A.G.A. for the State-respondents is present. The petition seeks quashing of the F.I.R. dated 17.9.2023 giving rise to Case Crime No. 587 of 2023, u/s 147, 148, 308, 323, 504, 506, 352 I.P.C., Police Station Civil Lines, District Aligarh. The impugned F.I.R. is u/s 308 I.P.C. Learned A.G.A. has also pointed out that there are two injured and both of them have head injuries. Under the circumstances, as the injury is in consonance with the F.I.R., the same is not liable to be quashed. Moreover, the allegations contain ingredients of cognizable offence. Such an F.I.R. is not liable to be quashed. The writ petition is therefore dismissed, without prejudice to the right of the petitioner to apply for bail/anticipatory bail.
