Judgment
Court No. - 3 Case :- WRIT - C No. - 39034 of 2023 Petitioner :- Ram Bishwash Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rajesh Kumar Singh,Atul Srivastava Counsel for Respondent :- CSC Hon'ble Siddhartha Varma,J. Hon'ble Shekhar B. Saraf,J. Heard learned counsel for the parties. The petitioner had applied for renewal of a lease which had completed three months in the year 1996. When one Somaru was given the lease and the petitioner who was at Serial No. 2 was not given the same, Writ petition being Writ - C No. 5484 of 1996 was filed. The Court had opined that Somaru was wrongly granted the patta and that the petitioner was entitled for the patta. However, we find that after the patta for three months was granted in the year 1996 much water had flown. In fact now even the tendering process as was available in the year 1996 had been done away with and the State Government had come up with the method of E-Tendering vide Government Order dated 14.08.2017. Further we are of the view that extension of lease could be done if it was either provided in the statute or it was provided in the lease itself. Here we find that the extension is not possible by the application of any law whatsoever. Under such circumstances, no interference is warranted in the instant writ petition. The writ petition is, accordingly, dismissed. Order Date :- 22.11.2023 vkj High Court of Judicature at Allahabad
