By means of this petition, the petitioner has prayed for a direction to the learned Special Chief Judicial Magistrate, Allahabad to decide the Criminal Case No. 23419 of 2022 (Nirmal Tiwari vs. Mahavir Prasad and others) under Sections 406, 419, 420, 467, 468, 471 IPC, Police Station Daraganj, District Prayagraj within a stipulated time. It has been submitted by learned counsel for the petitioner that the statement of the petitioner and witness have been recorded under Sections 200 and 202 Cr.P.C. and after submitting the report learned Magistrate has not passed any order for summoning the accused-respondents for trial and till date the matter is pending consideration. Perused the record as well as the order-sheet. Expeditious disposal of a case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it, expeditiously. Having regard to the facts and circumstances of the case, the court below i.e. Special Chief Judicial Magistrate, Allahabad is directed to make all possible efforts to decide the aforesaid case expeditiously.
