Since common question of laws and facts involved in the writ petitions, thus, both the writ petitions are decided by a composite order. The case of Dr. Shakeel is that he was issued an appointment as lecturer in B.Ed. department of the institution in question on
22.08.2019, approval whereof was granted on 23.01.2020, however on the basis of a forged resignation letter dated
22.12.2022, Dr. Shakeel has been stated to have resigned. The matter travelled to the respondents-University and a communication was issued on 17.06.2023 by the Registrar of the Mahatma Jyotiba Phule Rohilkhand University, Bareilly requiring the parties to appear before it. Prayer in the present petition is to cancel the resignation letter dated 22.12.2022. So far as the connected writ petition is concerned, the same has been preferred by the committee of management of the institution in question with the relief that the respondents-University be directed to cancel the appointment of Dr. Shakeel. It is not disputed between the parties that the matter is engaging attention before the Vice Chancellor of the Mahatma Jyotiba Phule Rohilkhand University, Bareilly and a communication has been issued on 17.06.2023, requiring the parties to appear along with the inputs for inquiry. Since the matter is engaging attention before the University thus the Vice Chancellor, Mahatma Jyotiba Phule Rohilkhand University, Bareilly is directed to conclude the entire proceedings within a period of six weeks from the date of presentation of the certified copy of the order. The counsel for the parties have made a statement that parties shall appear and cooperate on the date fixed in the matter. With the aforesaid observation, the writ petition is disposed off.
