¶1Learned counsel for the petitioners is permitted to implead the District Magistrate/Collector, Jalaun at Orai, District Jalaun as respondent no.8.

¶2Heard learned counsel for the petitioners and learned Standing Counsel for the State respondents.

¶3Petitioners claim right over the land bearing Plot no.538 (having share 1/1), Gram Panchayat Amita, P.S. Ait, Tehsil Konch, District Jalaun. The grievance of the petitioners is that Up Ziladhikari/Sub Divisional Officer, Konch, District Jalaun Sub Divisional Officer (respondent no.7) is harassing and interfering in their peaceful possession over the land in question at the behest of private respondents.

¶4Shri S.C. Upadhyay, learned Standing Counsel states that in response to the earlier order, the instructions are still awaited.

¶5Considering the facts and circumstances, we are not inclined to issue any direction to the Sub Divisional Officer. In case the petitioner files a fresh representation to the District Magistrate/Collector, Jalaun at Orai, District Jalaun within a weeks time ventilating all his grievance, we hope and trust that the Authority concerned would proceed to consider and decide the same in accordance with law in further two weeks. Needless to say that we have not adverted on the merits of the case.
