Sri Pankaj Kushwaha, learned counsel for petitioner after arguing for some time submits that after impugned orders were passed it was found that land allotted to petitioner is unfit for purpose of agriculture, however, this ground was never taken before the concerned authority and he prays that this writ petition may be dismissed as withdrawn with liberty to petitioner to file a recall/review application before concerned authority. Sri Vishal Khandelwal, learned counsel for contesting respondent has opposed above referred prayer. In the aforesaid circumstances, there is a prayer only to withdraw the writ petition which could not be denied, therefore, this writ petition is dismissed as withdrawn with aforesaid liberty.
