¶1Heard learned counsel for the petitioner.

¶2This petition has been filed seeking expeditious disposal of Misc. Case No. 247 of 2023 (Smt. Munni Devi Vs. Rakesh Kumar Gaur, deceased and others) filed Order IX Rule 13 C.P.C. pending in the court of Civil Judge, Aligarh.

¶3It is contended that the petitioner was not a party to the suit proceedings, however, she was impleaded for the first time in execution proceedings.

¶4Without examining the maintainability or the merits of the application moved by the petitioner, this petition stands disposed of directing the court concerned to decide the recall application on maintainability as well as on merits after providing opportunity to the decree holders on or before
