the State/opposite party no.1 and perused the record. By means of this application, the applicant has prayed for expeditious disposal of case being Criminal Case No. 1276 of 2005 (State Vs. Iliyas) arising out of Case Crime No. 152 of 2005, under Sections 147, 323, 504, 506 IPC, Police Station Belghat, District Gorakhpur pending in the Court of Judicial Magistrate, Bansgaon, Gorakhpur within the time-bound frame. It is submitted by learned counsel for the applicant that it is an old matter of the year 2005. The applicant is complainant/informant in this case. Charge-sheet was submitted on 17.10.2005 against the accused persons and charge was framed against them on 12.03.2012 but due to one reason or the another, trial was not proceeding effectively. Examination-in-chief of the applicant as PW-1 has been recorded on 09.11.2020 but till date, no cross-examination has been done. The trial is being delayed on account of repeated adjournments taken on behalf of the accused persons. Learned A.G.A. states that no useful purpose would be served in issuing notice to opposite party and keeping this application pending before this Court and it may be disposed of at this stage itself. Considering the limited grievance of the learned counsel for the applicant, learned trial Court is directed to make an endeavour to decide the aforesaid case, as expeditiously as possible, preferably within a period of nine months from the date a certified copy of this order is produced before it, if there is no legal impediment.
