Judgment

Court No. - 34 Case :- WRIT - A No. - 19472 of 2023 Petitioner :- Raghvendra Ahirwar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Bhriguram Ji,Shashi Shekhar Maurya Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.

¶1Heard learned counsel for the parties.

¶2By means of this petition, petitioner has challenged the order of suspension dated 07.08.2017 on the ground that he was placed under suspension merely upon being sent to jail in connection with a criminal case. However, later on he had been granted bail and now final report has been submitted there in connection with said criminal case.

¶3Counsel for the petitioner submits that meanwhile departmental inquiry was instituted by serving charge-sheet dated 24.08.2017 upon the petitioner to which petitioner submitted his reply and the inquiry officer namely Additional District Magistrate (Finance and Revenue), Jhansi has now submitted a final inquiry report. He, therefore, submits that there is no justification to keep the petitioner under suspension.

¶4Learned Standing Counsel submits that since now the departmental inquiry has been concluded, it would be more appropriate that the disciplinary authority is directed to conclude the disciplinary proceedings instead of any interference by this Court with the suspension order.

¶5In view of the above, therefore, this petition stands disposed of with the direction that the disciplinary proceedings in respect of the charge-sheet dated 24.08.2017 shall be concluded within a period of thirty days from the date of production of certified copy of this order. Petitioner shall be co-operating with the disciplinary proceedings so as to bring the same to its logical end. In the event, disciplinary proceeding is not concluded, as directed hereinabove, despite due co-operation rendered by the petitioner, the order of suspension dated 07.08.2017 shall stand revoked.
