¶1Heard learned counsel for the petitioner, learned Standing Counsel and perused the record.

¶2This writ petition has been filed for following prayer: "i) Issue a writ order or direction in the nature of MANDAMUS directing the respondent Nos.2 and 3 to restrain to the respondent nos.4 to 7 in peaceful possession of the petitioner over Gata No.33 Rakba 0.2670 hectare, situated at village Kurpura, Pargana & Tehsil Bidhuna, District Auraiya without any right over the said property.

ii) Issue a writ order or direction to the respondent no.3 to demarcate the Gata No.33 Rakba 0.2670 hectare, situated at village Kurpura, Pargana & Tehsil Bidhuna, District Auraiya by which respondent Nos.4 to 7 could not interfere in peaceful possession of the petitioner."

¶3From the perusal of the prayer as well as representation of the petitioner, it appears that petitioner has dispute with a private person.

¶4Learned Standing Counsel raised a preliminary objection that such a writ petition is not maintainable for a private dispute and in the garb of the present petition the petitioner wants to settle his private dispute.

¶5In view of the above, I am not inclined to interfere in the matter.

¶6Accordingly, the petition is dismissed with liberty to the petitioner to seek relief as available to him under law. Order Date :- 23.11.2023/Priya High Court of Judicature at Allahabad
