Applicants being accused have approached this Court through this application under Section 482 Code of Criminal Procedure seeking quashing of the proceedings of Criminal Case No. 97 of 2019, titled State Vs. Gauram Kushwaha and others, arising out of Case Crime No. 146 of 2019, under Sections 354A, 323, 506 I.P.C., Section 7/8 Protection of Children from Sexual Offences, Act, 2012, Police Station Madhogarh, District Jalaun as well as the cognizance order dated 10.10.2019 passed by Additional Sessions Judge (F.T.C.)/ Special Judge POCSO Act, Jalaun at Orai. During the course of hearing, when confronted with the maintainability of the application on the basis of a compromise in view of the decision of Hon'ble Apex Court in the case of State of Madhya Pradesh Vs. Laxmi Narayan and others, 2019(5) SCC 688, learned counsel for applicants prays for withdrawal of the application. The prayer is accepted.
