¶1Heard learned counsel for the petitioner.

¶2This petition has been filed seeking the following relief: "A. Issue a order or direction direct the learned Court of Civil Judge, (S.D.), Gorakhpur to decide the proceedings of Case No. 663 of 2019 (Anarkali Versus Kali Charan) on 28.09.2019 for permanent prohibitory injunction pending before the Court of Civil Judge (S.D.) Gorakhpur, expeditiously within stipulated period as fixed by this Hon'ble Court."

¶3It appears that the aforesaid suit was filed seeking a prohibitory injunction against the defendant-respondent and was filed on 28.9.2019. It is stated that neither has the defendant appeared nor has the case been decided.

¶4A perusal of the order-sheet reflects that the case was listed for ex-parte evidence on 20.4.2023 and now the case is being listed for ex-parte hearing.

¶5It is for the petitioner to appear before the court for hearing, for which dates are being fixed by the trial court. No direction as sought for is needed in the present petition.
