WRIA 19420/2023

Judgment

Court No. - 39 Case :- WRIT - A No. - 19420 of 2023 Petitioner :- Mukesh Kumar Respondent :- Union Of India And 5 Others Counsel for Petitioner :- Rakesh Kumar Dixit Counsel for Respondent :- A.S.G.I. Hon'ble Saumitra Dayal Singh,J. Hon'ble Shiv Shanker Prasad,J.

¶1Heard Shri Rakesh Kumar Dixit, learned counsel for the petitioner and Shri Gambhir Tripathi, who has filed appearance on behalf of the respondent.

¶2Solitary grievance of the petitioner is that the Original Application No. 330/00234 of 2021 (Mukesh Kumar Vs. Central Excise & Customs) though expedited vide order dated 03.12.2021 passed by the Central Administrative Tribunal, Allahabad Bench, Allahabad is not being listed for hearing. Referring to the judicial order dated 03.12.2021 passed by the Tribunal and further order sheet entry dated 09.02.2022, it has been submitted that the matter is only being listed before the Registrar.

¶3The above fact statement does not appear to be entirely true inasmuch as the order sheet entries dated 03.03.2022, 31.03.2022,

02.06.2022, 01.09.2022 and 18.04.2023 annexed to the writ petition reveals that the appeal has been regularly listed before the Tribunal, on the judicial side. Time and docket management are best left to the Tribunal concerned. Only this much is being observed, once the Tribunal has expedited the proceedings, it may make best efforts to conclude the same as expeditiously as possible.

¶4Accordingly, it is left open to the petitioner to approach the Senior Member of the Tribunal along with a copy of this order that may allow for proper docket management to be made as may address the grievance being voiced by the petitioner.

¶5With the aforesaid observations/directions, this petition stands disposed of. Order Date :- 23.11.2023 SA (Shiv Shanker Prasad, J.) (S.D. Singh, J.) High Court of Judicature at Allahabad
