¶1The instant petition has been filed for a writ of mandamus restraining the respondents from demolishing the construction existing over plot No. 21 Mauza Sukhmalpur, Nizamabad Mausuma, Mohalla New Ramgarh, Tehsil & District Firozabad without proper demarcation.

¶2Learned counsel for Nagar Nigam contends that the property belongs to Nagar Nigam and Nagar Nigam intends to demolish the pucca construction. Admittedly, there is no demolition order in existence nor any proceedings in that behalf has been initiated by the respondent-Nagar Nigam so far.

¶3In view of the above factual position, the instant petition is disposed of by providing that the respondent-Nagar Nigam will not demolish the pucca constructions existing over the land in dispute without following the due process of law.
