¶1Heard Sri Vijay Raj Pal, learned counsel for the petitioner and Sri Dinesh Kumar, learned Standing counsel appearing on behalf of respondent no.1 well as Sri Azad Rai, learned counsel for respondent no. 3.

¶2Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondents not to construct any road over the land of petitioner bearing gata no.397 without demarcation.

¶3Today when the matter has been taken up, learned Standing Counsel came up with the specific instructions which is taken on record through which it has been transpired that no construction has been carried out over the said land and the said land which was recorded as minjumla by mistake, has already been rectified by the revenue authorities in the revenue records.

¶4The grievance of the petitioner has already been redressed in pursuance to the prayer as made in the instant petition and as such, there is hardly any cause of action arises in favour of the petitioner to pursue the instant petition.
