Present writ petition has been preferred against the order passed by the Commercial Court in Misc. Case No.77/74 of 2022 in proceedings under Section 34 of the Arbitration and Conciliation Act, 1996. At the very outset, learned counsel for the petitioner states that he wants to withdraw the present writ petition with liberty to file an appeal. As the petitioner has an alternative remedy of filing an appeal under Section 37 of the Act, present writ petition is not maintainable. In view of the said fact, writ petition stands withdrawn with liberty to file an appeal before appropriate forum. With the aforesaid liberty, writ petition stands disposed of.
