¶1Shri Babu Lal, learned counsel appearing for the petitioner contends that he was not aware of the summoning order dated

19.11.2019 passed by the Additional Chief Judicial Magistrate, Azamgarh, therefore, he could not challenge the summoning order.

¶2Learned counsel for the petitioner submits that the petitioner came to know about the issuance of summons dated 5.6.2023, and thereafter, moved an application for inspection dated

6.6.2023, after inspection of record, applied for the certified copy of impugned order on 26.6.2023, and thereafter there is no delay on his part to challenge the impugned summoning order. Thus the summoning order dated 19.11.2019 may be set aside.
